ALBANY — The Court of
Appeals on Thursday upheld a lower court ruling that a
judge can not use the threat of contempt charges to compel a district attorney to prosecute a case, specifically addressing Albany County district attorney
David Soares» decision not to prosecute Occupy Albany protesters.
In March 2009 the House of Lords, citing cases from 1802 to 2008, allowed
