[2] Boston Red Sox outfielder Mo Vaughn's reason, stated by his lawyer, for failing eight sobriety tests (when asked to recite the alphabet, he couldn't get past P) and refusing to take
a Breathalyzer during an arrest for drunken driving.
At that point in time, the
arresting officer was required to again advise Mr. Russell of the right to a reasonable opportunity to contact counsel and to inform Mr. Russell that
during that time he could not elicit any incriminating response to the
breathalyzer demand.
