Unlike other jurisdictions which rely upon mandatory quota and affirmative action schemes to ensure more acceptable rates of
employment amongst their handicapped citizens,
Canadian governments have relied upon human rights
legislation.
There is no restriction in
Canadian employment law that prohibits an employer from terminating an employee, except for prohibited grounds under provincial and federal human rights
legislation.
Given the similarity of
employment legislation across
Canadian provinces, Alberta courts may adopt the same approach as cases arise.
Second, each
Canadian province has human rights
legislation that protects employees from discrimination in all aspects of the
employment relationship, including hiring, promotions, and termination.
Workers for employers who fall under federal jurisdiction are also protected by human rights
legislation in accordance with the
