Beginning in the 2010 - 2011 school

of students in grades other than those in which the State tests are administered; the performance
of limited English proficient students and / or other students with special needs; and the
progress that specific grades have made or that cohorts
of students in the school have made towards

If, after three full academic
years of implementing a restructuring plan, the school has not
demonstrated progress as delineated by the commissioner in the warning pursuant to subparagraph (i)
of this paragraph, the commissioner shall recommend to the Board
of Regents that the registration be revoked and the school be declared an unsound educational environment, except that the commissioner may upon a finding
of extenuating circumstances extend the period during which the school must
demonstrate progress.
In the event that a school placed under registration review prior to the 2010 - 2011 school
year demonstrates previously established
progress to be removed from registration review and is not identified in the 2010 - 2011 school
year as persistently lowest - achieving pursuant to subparagraph (9)(ii)
of this subdivision, the school shall be removed from registration review.
