In a first case, C - 431 / 11 UK v Council, the CJEU dealt with the choice of legal basis for a measure implementing an
European Economic Area (EEA) Agreement as regards
social security systems and ruled that it was precisely one of the measures by which the
law governing the EU internal market is to be extended as far as possible to the EEA, with the result that nationals of the EEA States concerned benefit from the free movement of persons under the same
social conditions as EU citizens.
«Finally, the link which the provisions of Chapter 13 of the envisaged agreement display with trade between the
European Union and the Republic of Singapore is also specific in nature because a breach of the provisions concerning
social protection of workers and environmental protection, set out in that chapter, authorises the other Party — in accordance with the rule of customary international
law codified in Article 60 (1) of the Convention on the
law of treaties, -LSB-...]-- to terminate or suspend the liberalisation, provided for in the other provisions of the envisaged agreement, of that trade.»
Under Article 27 (2) of the Rome I Regulation (Regulation (EC) 593/2008 on the
law applicable to contractual obligations), the Commission is charged with the task to submit to the EP, the Council and the
European Economic and
Social Committee a report on the proprietary aspects of voluntary assignment.
We regularly act in references to the Court of Justice of the
European Union, as well as in the UK courts and tribunals when EU
law issues arise — for instance in judicial review claims, tax and
social security tribunals, employment tribunals and damages actions.
Nevertheless, the CJEU skilfully manoeuvres around the possible guarantees included in its own case -
law on
European citizenship and the ones triggered by Regulation 883/2004 on
social security coordination.
So this is ironically the current state of affairs under
European law when it comes to the right to protection for non-nationals offered by
social assistance schemes.
He has written extensively in the field of
European Union
law and policy with a particular focus on the economic and
social governance structures of the EU.
78 However, the absence of such an autonomous and uniform definition under
European Union
law of the concepts of
social security,
social assistance and
social protection and the reference to national
law in Article 11 (1)(d) of Directive 2003/109 concerning those concepts do not mean that the Member States may undermine the effectiveness of Directive 2003/109 when applying the principle of equal treatment provided for in that provision.
This is

social security regulation came into being.
In Europe, four to six weeks of paid vacation time for employees is an entitlement that employees and the courts hold sacred and is, according to the Court of Justice of the

The legality of PBMs as instruments to promote positive global environmental and
social change is a familiar topic in WTO
law, but presently underdeveloped in the scholarship on
European integration.

Social Welfare, the Court of Justice of the
European Union answered this question positively in the Gusa - case of 20 December 2017: EU
law also protects the self - employed when they cease work due to circumstances beyond their control.
When the
European Parliament recently asked Frans Timmermans, the Commission's first Vice-President, in charge of Better Regulation, Inter-Institutional Relations, the Rule of
Law and the Charter of Fundamental Rights, to present his views on the institutional implications of the crisis before his hearings in the Parliament, he answered that the Union should respond to the crisis with «more coordination, more convergence, more
social dialogue and a better external representation».
In so doing, the Court significantly expanded the scope for taking
social interests into account within competition
law analysis and rejected the more narrow and liberal approach taken by the Dutch National Competition Authority (NCA), the Dutch government and — not surprisingly — the
European Commission.
Her practice is of an advisory, regulatory litigious nature and has included judicial review, actions for damages before UK courts, the superior courts of Ireland, specialized tribunals, the
European Court of Justice and General Court in cases concerning a wide range internal market issues, ranging from public procurement to goods and services, energy, agriculture competition and
