to believe that our neighbours lack the same
free access.
As you are likely well aware, one of the longstanding barriers
to free access to legal information has been the control of
law makers (governments, courts, tribunals and other decision making bodies) over the underlying copyright of that information.
On June 10th, my colleagues in the Stanford University School of Education listened patiently
as I stood before them explaining how the Harvard
Law School had passed an «open
access» motion which was going
to lead
to free online
access to all of the scholarly articles that they published.
The official announcement cites that it is: «For service
to the
law through the development of
free electronic
access to legal information, and
as a leader in the protection of privacy.»
The 3 day event included the annual get together of the
Free Access to Law Movement, CanLII's peer group from around the world,
as well
as 30 + papers, presentations and panel discussions from a highly varied cross-section of legal information innovators.
Its collaborator in this endeavour, Lexum, then a legal info technology lab at the University of Montreal, has gone on
to play a significant role in many other Canadian achievements essential
to securing
free access to law in Canada, most notably through their role

Although the Supreme Court of Canada held in Christie that a «general
access to legal services in relation
to court and tribunal proceedings dealing with rights and obligations» is not a fundamental aspect of the rule of

free from government regulation or control of any kind, even when,
as now, it has made legal services unavailable at reasonable cost
to a large majority of the population.
