The Court began its analysis by noting that the standard of
review of
jury verdicts is «exceptionally high» and that a
jury's
verdict is entitled to a «fair and liberal interpretation in light of the evidence and of the circumstances».
Based on a
jury verdict for respondent, that court entered judgment against petitioner for $ 100,000, and, after
review in both the Florida District Court of Appeal and the Supreme Court of Florida, the judgment was ultimately affirmed.
While courts do not acknowledge or encourage
jury nullification, judges take «no steps... to prevent jurors from nullifying, jurors are not subject to legal sanction for nullifying, and
verdicts that are the result of nullification are not subject to
review» (Hreno, at para. 2)
