State
law dictates
schools divide teachers into four
categories — highly effective, effective, needs improvement and ineffective.
Statewide, 40 federally aided
schools were pushed into the «choice»
category, joining 37 included under the earlier
law.

law calls for states, beginning in
school year 2017/18, to use accountability indicators, disaggregated by subgroup, to annually differentiate public
schools by several

The report noted that black students are disproportionately dealt the harshest exclusionary penalties — expulsions and out - of -
school suspensions.1 In 2014, the California state legislature passed a state
law (AB420) prohibiting public
schools from expelling any student or suspending students in third grade or earlier grades for the offense of «willful defiance» — a catchall
category of offenses (including disruption) ranging from shouting obscenities at a teacher to forgetting to bring a pencil to class.
According to a
law passed in 2015, any district earning marks in the «Fails to Meet Expectations»
category two years in a row, becomes eligible for state intervention in the form of an initiative dubbed the Opportunity
Schools and Partnership Program.
The attorneys cite three
categories of
laws that are being challenged: the state has put a moratorium on new magnet
schools, «arcane and dysfunctional»
laws that govern public charter
schools and the state's inter-district open choice enrollment program that penalizes
school districts that accept students from inner - city
school districts.
The GAO's analysis examines six
categories of discipline: out - of -
school suspensions, in -
school suspensions, referrals to
law enforcement, expulsions, corporal punishment, and
school - related arrests.
Schools also have legal obligations to address bullying that doesn't fit neatly into any of the
categories protected under civil rights
laws.

The state must decide a methodology for identifying
schools (based on the system of differentiation) for comprehensive support and improvements, and the option of designating additional
categories of
schools, beyond what is required by the new
law, should be included.
