ML Policy Committee April 2010 Dear Michael, I am writing as President of the Council of Multiple Listing Services (CMLS) to respectfully request a policy clarification from the NAR Multiple Listing Policy Committee regarding the requirement for listing brokers to submit listing photos and legally required disclosures on the MLS system.

At the 2008 Midyear meeting, the National Association's Multiple Listing Issues and
Policies Committee received the March, 2008 Report and Recommendations of the
MLS Cooperative Compensation Work Group.
It is the consensus of the NAR Multiple Listing Issues and
Policies Committee that any listing agreement between a seller and a listing broker that provides that cooperative compensation can not be offered or paid to a cooperating broker if the purchaser holds a particular license or credential, engages in a particular trade or profession, or if the range of potential purchasers is otherwise arbitrarily restricted, places an unwarranted condition on listing brokers» offers of cooperative compensation and is not and should not be eligible for inclusion in
MLS.
At the 2005 Annual Convention, Ann Hale Bailey discussed branding issues with the
MLS Forum and, at the subsequent meeting of the Multiple Listing Issues and
Policies Committee, there was sentiment for convening a work group of the
Committee to review and act on the issues raised by Ms. Bailey.

That a work group of the Multiple Listing Issues and
Policies Committee consider how best to ensure that representations
MLS participants make to consumers about availability of
MLS - provided information are accurate.
The issue was brought to light by The Realty Alliance, which sent a letter this January to the
MLS Technology and Emerging Issues Advisory Board of the Multiple Listing Issues and
Policies Committee.
Also in 2015, the NAR
MLS Committee approved a
policy requiring MLSs to provide at least three years of sold data for display on participants» IDX sites, and that
policy was expanded last year to require MLSs to provide all sold data available as of 2012.
If the proposal passes the
MLS Committee, Executive
Committee, and Board of Directors at NAR's 2017 REALTORS ® Conference and Expo in November, the amendments to
MLS Policy Statements 7.42 and 7.43 would become effective on July 1, 2018.
