Section thirteen of the Canadian Human
Rights Act (CHRA)
bans the electronic transmission of material that is deemed «likely to expose persons to hatred or contempt by reason of the fact that those persons are identifiable on the basis of a prohibited ground of discrimination.»
Although Parliament voted last June to repeal section 13 of the Canadian Human
Rights Act, which
bans hate speech on the Internet discussed in this previous post, it has yet to receive Royal Assent by the Senate.
Section 153 of the Small Business, Enterprise and Employment
Act 2015 amends the Employment
Rights Act 1996 (ERA 1996) by inserting a new s 27A
banning the use of exclusivity clauses and for the first time giving a statutory definition of a zero hours contract.
One issue that arises is whether this absolute
ban is compatible with the
right of freedom of expression, as laid down in Art 10 of the European Convention on Human
Rights (the Convention) and transposed by the Human
Rights Act 1998.
Some scholars had certainly doubted whether the British
ban could pass muster as compliant (see Eric Barendt, Freedom of Speech (2005), pp 484 — 86 and Helen Fenwick and Gavin Phillipson, Media Freedom under the Human
Rights Act (2006), pp 1012 — 36).
