Scottish Civil Courts Review may have a serious impact on the effectiveness of the current
Court of Session procedures, in that they will be moved to the Sheriff
Court, Lord Jackson, although approving of the
Scottish system, was aware of the need for protection against awards of costs, which is of course currently widely available in England through the provision of ATE insurance.
