native title rights to exclude those exercising public rights to fish or navigate in the
sea or the inter-tidal zone can not be recognised.11 Rejecting the applicants» argument that a
native title right to exclude people permanently from small areas or to exclude temporarily from areas in the
sea according to Yolngu traditional laws and customs is not inconsistent with the public right to fish and navigate.12 Parties are invited to make submissions on the proposed determination.
The decision of the Full Federal Court in the Croker
Island case is analysed in the Report as an example of how the legal system imposes severe limitations on the recognition of traditional fishing rights and the spiritual connections that exist between the Indigenous
native title groups and the
sea.
The Croker
Island case was the first judgment to analyse the nature and extent of
native title rights over
sea country.19 In the first instance, Justice Olney found that although
native title rights did exist within the determination area, as a matter of law they were not exclusive in nature.20 This was due to the fact that the
native title rights were affected by, and considered to yield to, the right of innocent passage and the common law right of the public to fish and navigate.21 The right of the claimants to use their traditional lands operated only to the «extent of the inconsistency ’22 and as such could not be utilised to prevent others from fishing or carrying out commercial activities in the area.
On 11 October 2001, the High Court determined that the Yarmirr people of Croker
Island have a
native title right to fish in their
sea country.2 It was the first Australian decision to recognise Indigenous peoples» right to
native title over the
sea.
In fact, I am one of the principal respondents to the Croker
Island test case of
native title over
seas.
[93] The initial decision in Croker
Island was given in September 1998, legally recognising that Indigenous people have
native title rights in the
sea.
Commissioner Gooda said the decision came 18 years after the historic High Court decision in Mabo which found that
native title existed on Murray
Island, and almost nine years after the Torres Strait Regional
Sea Claim was filed in the Federal Court.
There are few cases from overseas jurisdictions that have dealt with the issues of
native title
sea rights so exhaustively as the Croker
Island case.
However, the decision does not mean the only
native title rights that can be recognised in the
sea must be co-existing: exclusive aspects of
native title
sea rights that are compatible with public rights (fishing, navigation or innocent passage) were not ruled out by Croker
Island.
Other uninhabited
islands and the surrounding
sea have
native title claims over them, but are yet to be determined.
While the Croker
Island decision supports the existence of non-exclusive
native title rights over
sea country, the result did not necessarily exclude future
native title applicants from establishing
native title rights to fish commercially — two distinct concepts.
