EDIT March 9, 2016 So I took the car to a guy who specializes in ATX gears, and he felt that it's not
a tranny problem.
Because simply put I'm concerned about the safety of my family first and formost and I can look past cheap build parts but I can't look past
these trannys problems!!
Overall, I'm pretty happy with the truck now that
the tranny problem seems to have been rectified and pleased with the warranty work although I did have to pay a little extra to have the truck towed to the dealership of my choice to do the repair work since the two closer dealerships have horrible service departments.

The cause of the shifting
problems was from low and burnt
tranny fluid.
No
problem: Set the chassis to Comfort and the
tranny to Sport +.
All of my manual
tranny cars have done that in 1st which is why I use the clutch at the same time I use the accelerator pedal, but none had the
problem in 5th, so perhaps you just have a more severe form of that
problem.
(90's won't have these
problems but still may need to relearn engine cycles,
tranny shifting, etc.).

i think it was gearbox
problems because he re-engaged the
tranny and was about to pull back on track and the officials stopped him.
If you turn VDC off today, do your thing (drag / road course / etc) and the
tranny goes bad at that moment, the warranty will not hold, BUT if the
problem arise some time later after turning VDC off back on and driving the car without any issues and then BAMMM... the
tranny will be covered 100 %.
The engine has held up quite well with nearly 190,000 miles on it, and the only major
problem was a broken
tranny oil pan.
First the
tranny at 35k (in the end Jeep's Chief Engineer diagnosed the
problem), 6 months in shop; the rear end at 60k, in a month, centre differential at 75k, 2 months in shop, centre diff again, at 80k.
