The case law seems to suggest that, rather than deciding public access

universities, the amount of public funding received, or their
library's depository status, librarians can consider the individual characteristics of their own
universities — the
university's mission, their patrons» needs, their financial circumstances, and the place they see for their academic
library in the larger community.
