about a victim of a crime, abuse or other harm to a law enforcement official, if the law enforcement official represented that: (i) The information was needed to determine whether a violation of law by a person other than the victim had occurred; and (ii) immediate law enforcement activity that depended on obtaining the information may have been necessary.
The final rule clarifies that covered entities may disclose protected health information
about a victim of crime where a report is required by state or other law, and it requires the victim's agreement for disclosure in most other instances.
In addition, under proposed § 164.510 (f)(3) of the NPRM, we would have allowed covered entities to disclose protected health information
about a victim of a crime, abuse or other harm to a law enforcement official under certain circumstances.
