Cases of medical malpractice result from negligence on the part of the medical care provider which
causes actual physical harm to the patient.
I suspect that the number of drivers who would
fear actual physical harm from an encounter with a police officer would be a lot less than a majority.
In the case of an assault, for example, you do not need to show that a person's action caused
you actual physical harm, but only that you expected some harm to come to you.
However, the legal definition of assault does not require
any actual physical harm to be perpetrated against a victim.
