An interference would be considered «necessary in a democratic society» for a legitimate aim if it answered a «pressing social need» and, in particular, if it was proportionate to the legitimate aim pursued and if the reasons
adduced by the national authorities to justify it were «relevant and sufficient».
For this purpose, the judicial
authority must be in the position to take into consideration three sets of material: the facts and the evidence
adduced by the administrative
authority, the observations on behalf of the third - country
national and any other element that is relevant.
