This spring I talked about why everyone seems to be
advertising consumer proposals.
Not everyone
advertising consumer proposals on the web is licensed to file proposals.
This practice and scam has become so concerning that the Office of the Superintendent of Bankruptcy is investigating these debt consultant stories and reviewing their practice of
advertising consumer proposals which they can not legally provide.
Yet you see many people
advertising consumer proposals, or a similar type of «government debt settlement program» all over the internet.
Other agencies may
advertise consumer proposals, but they would have to refer you to a consumer proposal administrator to file one.
Instead of doing their own negotiating, they now
advertise consumer proposals and charge fees to «process your paperwork» and «work on your behalf» only to refer you to a licensed Consumer Proposal Administrator.
Not exact matches
The
proposal states that producers «shall disclose to the
consumer information regarding the non-cash compensation that exceeds $ 100 per producer per year the producer receives from an insurer or intermediary that is tied to the sale of annuities including, but not limited to, gifts, meals, trips, entertainment, prizes, marketing, and
advertising.»
Recently I have seen
advertising that attempts to scare people into filing bankruptcy or a
consumer proposal to stop a payday loan wage garnishee.
There are lots of companies
advertising «deals to reduce you debt by up to 70 %», but unless they are trustees (you'll know because trustees are required to tell you that they are trustees in their ads) they are going to have to refer you to a trustee in order to file a
consumer proposal.
To help clarify matters, today I am going to compare
consumer proposals to some of the other services that are available and more importantly, being
advertised to sound like
consumer proposals.
What they don't say is that they are
advertising the exact same service that only a Licensed Insolvency Trustee can administer: a
consumer proposal.
Massachusetts lawyer Robert Ambrogi said that the
proposals strike a «sensible balance» between the need to regulate lawyer
advertising and lawyers» ability to use technology to educate
consumers.

Their
proposal for a new national MLS site could be a good one, however they state in their presentation that the site should not
advertise its presence to the
consumer.
The 2010 Mortgage
Proposal also proposed significant protections for reverse mortgage
consumers, including with respect to
advertising of reverse mortgages and cross-selling of reverse mortgages with other financial and insurance products.
