Interestingly, while the legal futures discourse seems
to be centred
on how changes will
affect big firms, the
access to justice debate appears
to occur within smaller, more focused groups.
It impacts
on the decision and strategy
on whether
to litigate even with a meritorious claim, and is becoming an issue of
access to justice, especially for impecunious litigants who are disproportionally
affected by the recovery gap.
It is too early
to know what action should flow from the evidence, but it is anticipated that this may include an array of reforms
affecting formal court procedures, frontline legal service entry and information points, changes in legal and judicial culture, alternative models of legal practice, multi-sector perspectives
on investment in
access to justice, and effective public involvement in the change process.
The LCO's Framework for the Law as It
Affects Persons with Disabilities, created in conjunction with the LCO Report
on Disabilities, is specifically intended
to assist those that create, review and implement laws, policies and initiatives in addressing barriers
to access to justice experienced by persons with disabilities.
The case has drawn interest from more than a dozen interveners, including the Attorneys General of Ontario and Canada, as well as a number of civil rights and media organizations, who have weighed in
on how such an order would
affect free speech rights, international comity, and
access to justice.
In fact, every federal politician should be informed about and have a position
on Access to Justice issues in 2015, not least because so many of their constituents are and will be
affected.
While the impact
on small firms is unlikely
to move the needle, lawyers across the country, including the Canadian Bar Association, have raised concerns about how the changes negatively
affect access to justice.

to watch an appeal that will
affect private arbitrations and
access to justice across Ontario.
