Unvalidated
debt should not be reported to the credit reporting
agencies even though some
debt collectors may try to get around it.
FDCPA expert witnesses are often asked to opine about the practices of a 3rd party
debt collector and the potential impact of the collection
agency account on a consumer's credit reports and credit scores.
These
debt collectors are more commonly referred to as collection
agencies.
According to a recent Bloomberg analysis, the Department pays its
debt collectors nearly $ 40 for every $ 1 dollar they collect: meaning that for the collection
agencies to collect $ 5 million, taxpayers would likely shell out almost $ 200 million in commissions.
Collection
agencies are commonly known as
debt collectors as well as bill
collectors (they're known by harsher names too but I won't print them here).
If you think that a
debt collector has violated your rights, you can file a complaint with the Federal Trade Commission and the collection
agency can be ordered to pay you up $ 1,000.
It is unlikely to be worth employing a
debt collector to try to recover the
debt, as it may cost the creditor more to pay the
debt collection
agency than they get back.
If you have requested
debt validation and the
debt collector can not validate, dispute the
debt and request the credit reporting
agencies remove the unvalidated
debt from your credit reports.
Sending the letter certified mail return receipt requested will allow you to prove you sent the letter to the collection
agency in the event you decide to sue the collection
agency (for example, if
debt collector attempts to collect the
debt from you before validating the
debt after you've requested validation, you may be entitled to sue them for $ 1,000 for each infraction)!
In many cases, the
debt collection
agency is unable to sufficiently prove that you owe any money at all (as per FTC guidelines) and the
debt collector can not make any further attempts to collect money from you until the
debt is proved to be valid.
As I have written in a previous article about settling with
debt collection
agencies, one method to settle with a
debt collector is to send them a letter offering a percentage of the account balance as «Paid in Full».

Unfortunately, we do not have any data about the success rate of that counseling, nor will the Department of Education release an unredacted version of the Private Collection
Agency Manual so that we can see how it has instructed its
debt collectors.
Some
debt collectors will settle for less then turn around and hire another collection
agency to collect the difference.
Beware of false promises by the collection
agency Not surprisingly, some
debt collectors use dirty, underhanded tactics to collect
debt.
It may take some extra work but many have been successful in bugging a
debt collector enough with disputes and complaints to state and federal
agencies and the Better Business Bureau, that they give in and delete.
However, the federal law applies only to
debt collectors working for designated
debt collection
agencies and professional lawyers hired for
debt collection purposes.

debt collector could be the original credit or service provider collecting the
debt themselves or a
debt collection
agency acting on the creditor's behalf.
