The Real Estate Council of Alberta (RECA) has been
taking a very pro-active role in steering our industry and although not carved in stone, transaction
brokerage and designated
agency appear to be on the horizon.

taken ownership of the merged
brokerages.
The way I see it, the existing legislation governing the Laws of
agency prevail, regardless of the steps any
Brokerage believes it has
taken to abdicate its obligations and responsibilities under the law.
The
brokerage would not start out, as it does today, as the sole agent for one of the parties, with every licensee engaged by the
brokerage taking on the same status, and then have to strip away many of its
agency obligations (and simultaneously stop being able to provide the
agency services it initially offered) to become an impartial dual agent in an «in - house» transaction.
The main difference between today's role of the
brokerage as a dual agent, and the proposed role of the
brokerage as a transaction facilitator, is that this is the role of the
brokerage that would be established from the outset, either when a listing is
taken or a buyer
agency agreement is signed.
The new rules, which
take effect on Dec. 1, 2015, eliminates limited
agency and allows
brokerage firms to adopt designated
agency.
This means that whenever a client enters into an
agency relationship with the
brokerage, all licensees at that
brokerage take on the same duties in relation to that client.
