contracts, not closings,
fell more than expected, with real estate
agents blaming a severe lack of listings, especially in more affordable price ranges.

agent does the job right, that the buyer should be eligible to get their deposit back if the financing
falls through, per the
contract.
Lots of real estate lawyers receive calls about this scenario — The escrow
agent willfully breaches the
contract or is grossly negligent for misdelivering the deposit to the buyer or the seller when there is a dispute i.e. there are conflicting demands for the deposit because the transaction has or is
falling apart.
The major issue with trying to sell with a realty
agent or marketing it yourself is many times retail purchasers will bind a home for weeks with a
contract and pull out on the transaction at the last second... or have their mortgage
fall through which means they get their earnest money back.
I think the inspection is one of the most important contingencies in the sales
contract and have seen far too many transactions almost
fall apart when there is not clear and concise communication between the buyer's
agent & listing
agent when it comes to negotiating items that come up as a result of a home inspection.
