After previously issuing a
draft policy related to these WSIA
amendments and considering stakeholder feedback, the WSIB has now finalized and
approved a new policy, entitled «Chronic Mental Stress (Accidents on or After January 1, 2018)» (the «CMS Policy»).
The CAT was also satisfied with the litigation funding arrangements in both cases (Pride, § § 140 - 145; Merricks, § § 95 - 140); although it strongly criticised the «impenetrable»
drafting of the American - style funding agreement in Merricks, and was only prepared to
approve it in light of
amendments proposed at the hearing: § § 121 - 127.
It now appears that many documents may constitute a will: a
draft prepared by a lawyer,
approved by the client but unsigned at their death; handwritten notes referring to particular property, including jewellery and personal items; and handwritten
amendments on a copy of a will.
