One of the shortcomings of the
new arrangements in Indigenous affairs has been the tendency to characterise all problems besetting Indigenous
communities as the result of failed processes - whether it be during the ATSIC era, or more recently, a lack of coordination on the part of governments
in respect of service delivery.
In light of the importance of the lessons from the COAG whole of government
community trials for the implementation of the
new arrangements, the Social Justice Commissioner will over the coming twelve months:
This approach has been taken, despite the government's oft repeated conviction that there were serious failings
in the modalities of engagement with Indigenous
communities in the era of «self - determination» or «self - management» (essentially from the 1970's through to the
new arrangements in July 2004).
It is also possible if the
new arrangements are not transparent
in their operation and rigorously monitored, and if there is a systemic problem with government not placing enough emphasis on the skills necessary to engage effectively with Indigenous
communities (through the establishment of appropriate recruitment, retention and training approaches across the public service and provision of adequate support for Indigenous people and
communities to have
in place appropriate governance
arrangements.)
In this regard, I have consistently expressed concerns at the recruitment practices adopted through the
new arrangements to date because they do not sufficiently recognise that the ability to communicate effectively with Indigenous
communities is an important and essential skill and an integral component of all merit based selection processes.
That there be established a regular federal parliamentary committee of inquiry into the progress of the
new arrangements in Indigenous affairs and progress
in achieving whole of government service delivery to Indigenous
communities.
One Regional Council expressed concern that the lack of involvement of the Regional Council
in the introduction of the
new arrangements has affected the relationship of the Council with
communities:
The next section of this report discusses the challenge for the
new arrangements of engaging with Indigenous
communities and ensuring the participation of Indigenous peoples
in decision making and program design.
There are a number of mechanisms under the
new arrangements that will facilitate improved service delivery to Indigenous people living
in non-remote
communities, including SRAs...
Turning first to the increased authority for the ICC and state managers, this appears to be an attempt to find a way around the red tape that has tied up the
new arrangements and hindered the delivery of substantive outcomes
in communities.
Given the
new arrangements... there is a need for agencies to institute training programs, particularly to those that have a direct role
in servicing Indigenous clients or manage programs with a significant Indigenous component / focus, which include some form of cross-cultural training, an Indigenous historical component to understand how to assist
in building
community capacity.
I note that through the
new arrangements, the Government has made commitments to work
in partnership with Indigenous people and
communities, including through regional representative structures and at the local level.
The genesis of the
new arrangements are to be found
in the agreement
in April 2002 of the Council of Australian Governments (COAG) to trial a
new whole of government approach to the delivery of services to Indigenous
communities at eight selected trial sites:
This lack of progress is exacerbated by the lack of engagement with ATSIC Regional Councils
in the process and also by the insufficient information provided to Indigenous people and
communities about the
new arrangements in general.
I am looking to ways for Indigenous people to inform me of developments
in their
communities as these
new arrangements come into place.
The federal government's tendency to deliver important policy decisions
in Indigenous affairs as a fait accompli — even to territory and state governments — raises serious concerns about the ability of Indigenous
communities to negotiate as equal partners
in the many agreement making processes that have been introduced with the
new arrangements.
The
new arrangements recognise that,
in order to develop policies that are responsive to the aspirations, priorities and decisions of Indigenous people, there needs to be better
community based structures at the local and regional level.
For example, the
new arrangements should be able to provide mechanisms to support viable aspirations of smaller
communities located on traditional country (outstations), and to develop appropriate enterprises
in order to provide such
communities with a degree of autonomy, purpose and stability.

In correspondence with my office about the
new arrangements, the following departments indicated that their policies require the use of Identified Criteria where the position involves service delivery to Indigenous people or
communities:
It is regrettable that Regional Councils, with their ability to communicate widely with Indigenous people and
communities and their experience engaging with service deliverers at the regional level, have not been more integrally involved
in the introduction of the
new arrangements.
Thus, as I pointed out
in the Social Justice Report 2004, the emphasis
in the
new arrangements on remote discrete Indigenous
communities poses difficulties for Indigenous peoples
in urban areas.
It is indeed possible that the level of coordination and integration of services required under the
new arrangements will prove to be too complex
in implementation, and that the delivery of services to Indigenous
communities will collapse under the weight of inordinately complicated and unrealistic
arrangements.
I noted the failure of the
new arrangements to build on significant progress and experience
in the health sector, or to develop effective relationships with the extensive local Aboriginal
Community Controlled health sector.
The Congress would provide the opportunity to compare best practice and the experiences
in each region relating to the implementation of the
new arrangements and service delivery to Indigenous people and
communities.
Of particular importance
in terms of the
new arrangements has been the progress made
in 2003 and 2004
in the eight COAG whole of government
community trial sites.
Providing rights and responsibilities education for this body of Indigenous young people, particularly as they near working age, will be an important part of the shift away from a «welfare mentality» that must occur
in many
communities if the
new arrangements are to be sustainable.
These changes, which are additional to the
new arrangements, are broad
in scope and touch nearly every area of interaction between Indigenous
communities and governments and the lives of Indigenous peoples.
For Indigenous peoples, the challenge of the
new arrangements is to ensure that they have an appropriate voice
in determining the priorities that face their
communities.
The Queensland Cabinet endorsed such principles as improved partnership
arrangements between the State Government, business leaders and Cape York
communities to better address the disadvantage experienced by Cape York Indigenous people; integration and enhancement of existing planning processes between State Government, business leaders and Cape York Aboriginal
communities to identify and implement trials of
new operating practices; and encouragement of the Commonwealth Government to participate
in the process at an appropriate stage.
The
new arrangements for the administration of Indigenous affairs have not engaged sufficiently with the health sector
in settling regional priorities and engaging with Aboriginal and Torres Strait Islander
communities.
For Indigenous people the challenge of the
new arrangements is to ensure that they have an appropriate voice
in determining
community priorities.
There are a number of useful programs that have been underway that highlight key issues relating to the capacity of Indigenous
communities to be able to participate on an informed and equal basis
in the
new arrangements.
Torres Strait Islander people living on the mainland have been invited to, and participated
in, meetings on the
new arrangements in Indigenous affairs, particularly
community consultations on
new regional representative bodies, and will be able to continue their involvement
in planning through the
new representative mechanisms.
Community - based resources could provide a range of parenting programs that could be sensitive to a variety of needs and concerns, including information and support for
new parents
in planning their return to work and choosing child care
arrangements.
