On May 12, 2009, Georgia Governor Sonny Perdue signed into law amendments to the Medical Practice Act of the State of Georgia that clarify and protect the authority of physicians to delegate to medical assistants.

In traditional ambulatory care settings — in which physicians are delegating duties directly to medical assistants, or are authorizing their mid-level providers to oversee and delegate to medical assistants — the operative law is the state medical practice act and the regulations and decisions of the state board of medical examiners.

A question has arisen about whether the medical assistant's right to be delegated duties by a physician is undermined by the Nebraska Nurse Practice Act and the Nebraska Administrative Code.

As reinforcement of this legal principle, it is noteworthy that there is no reference to medication aides / assistants in the Medical Practice Acts and regulations of any American jurisdiction, or in the Essentials of a Modern Medical Practice Act of the Federation of State Medical Boards.
