by outgoing Sacramento Mayor Kevin Johnson, «about his efforts to take control of the National Conference of Black Mayors,
bankrupt it, and open a new organization that would promote charter schools.
If a
bankrupt is not eligible for automatic discharge, the
bankrupt can receive an Absolute
Order of Discharge issued
by the
court once all duties are completed.
For example, an
order of discharge does not release a
bankrupt person from any debt arising from an award of damages
by a
court in civil proceedings stemming from «bodily harm intentionally inflicted, or sexual assault»:
Notwithstanding the terms of a consent
order, which provided that a sale of a matrimonial home in which a
bankrupt had an interest be postponed until the happening of specified events, it would be open to a
court, on an application
by his trustee in bankruptcy under s 14 of the Trusts of Land and Appointment of Trustees Act 1996, to make an
order for the sale of the property.
During that time, the
bankrupt's ex-wife had lived
by herself in the property pursuant to a
court order made in 1985 allowing her to live in the property until she remarried, cohabited, died, or wished to sell.
(d) the
court is satisfied that the interests of the
bankrupt's creditors may be affected
by the making of an
order under this section in the proceedings;
(2) The liability under subsection (1) of a
bankrupt party to a marriage to maintain the other party may be satisfied, in whole or in part,
by way of the transfer of vested bankruptcy property in relation to the
bankrupt party if the
court makes an
order under this Part for the transfer.
