The mother filed a motion for summary judgment seeking an order that, among other things, the father pay child support
based on the Child Support Guidelines, an order that the father pay his share of the child's section 7 expenses, and that the father settle unpaid child support (i.e. arrears).
When the children are under the age of majority, the amount of support payable by a parent is simple to calculate as it is
based on a Child Support Table.
As background: Originally, the father had been ordered to pay $ 520 per month in child support for the couple's two daughters,
based on the Child Support Guidelines.
In Ontario, child support is determined
based on the Child Support Guidelines and is payable to the custodial parent along with any extraordinary expenses that are not covered by the guidelines.
The judge determined that the father's income was in fact at least $ 705,000 and payable
based on the Child Support Guidelines.
By reducing income assistance dollar for dollar
based on child support or child maintenance, the government is profiting off of the backs of the poorest children in the province.
Additionally, the court may place liens on property owned by the noncompliant parent, and in some situations, deny passport applications
based on child support owed.
