A North Carolina appeals court has found that
a broker committed fraud by failing to tell a client that he owned the property the client was purchasing and that the property had been condemned.

a broker committed fraud when he failed to disclose to his client that property purchased by the client had been condemned and also that the broker was the owner of the property.
The appellate court also supported the trial court's decision that
the broker committed fraud.

brokers committed all kinds of

Because of this duty to supervise its licensees and also because the licensees are acting in the
broker's name during their transactions, the trial court ruled that
brokers are vicariously liable for intentional torts such as
fraud committed by its licensees while they are performing their duties as a salesperson.
If the practitioner writes up the purchase agreement as a residential purchase knowing the deal is being mischaracterized by the mortgage
broker or loan officer, the practitioner could be found to have
committed loan
fraud.
The buyer had evidence of disputed fact issues on whether the seller's real estate

committed fraud or was negligent in handling the real estate transaction where the square footage of the property was inaccurate.
