This tactic would not work in
a budget reconciliation bill because it would violate the Byrd Rule (because waiver itself does not produce a change in outlays or revenues).
These are good things that were all included in the 2015
budget reconciliation bill, which passed both houses of Congress.
But the Senate parliamentarian on Friday found that the Senate would need 60 votes, rather than a simple majority of 51, to attach the amendment to a health care and
budget reconciliation bill.

Note: that this was after Ted Kennedy died and Scott Brown was elected, so the Senate bill was already set in stone, so any changes after he made those remarks would have come in
the budget reconciliation bill that was designed to fix the bill.
