Rarely should there be any reason
for you to pay the full dollar amount requested

Debt collectors can be pretty slick, and may try to acquire this information
by casually asking
for your work number.
Once that's done,
by law the
debt collector may contact you just once more, and only

by other individuals or it can be heard
by other individuals, than a
debt collector who leaves a message on that machine will likely have violated the FDCPA.
Consumer advocates are concerned that the FTC proposal does not provide
for legal action or other sanctions against
debt collectors that «step over the line» in attempting to collect
debts incurred
by deceased borrowers.
And many student loans require a co-signer in order
for the loan to be approved, which means if something happens to the primary borrower, the co-signer may suddenly be pursued
for the student loan
by a
debt collector.
And while the CFPB brief is regarding a case filed in New York State, the points raised apply
for all debtors being contacted
by a
debt collector.
If you feel that you have been harassed
by a
debt collector, there are actions that you can take to end the harassment and hold the
debt collector accountable
for their actions.
The healthcare industry is the single biggest customer of the
debt collection industry, constituting 42 % of the collection market, versus only 29 %
for the banking & finance sector.34 One stunning statistic from a 2003 Federal Reserve study is that over half of accounts reported
by debt collectors and nearly one - fifth of lawsuits that show up as negative items on credit reports are
for medical
debts.35 Moreover, often medical
debts are sent to
debt collectors for reasons completely out of the consumer's control, such as disputes between insurance companies and providers, or even the result of the provider's failure to properly bill the insurer.

My potential client inquiries (
for cases I can take) are probably about 85 % involving a
debt collection lawsuit and about 15 % involving harassment
by a
debt collector.
Usually about once a month I'm told
by a
debt collector or opposing counsel «your case is garbage
for the following reasons...» That conversation usually ends with a settlement offer, despite the fact that my case «has no merit.»

Thus, so long as the use of
debt collectors is consistent with the regulatory requirements (such as, providers obtain the proper consents, the disclosure is of the minimum amount of information necessary to collect the
debt, the provider or health plan enter into a business associate agreement with the
debt collector, etc.), relying upon
debt collectors to obtain reimbursement
for the provision of health care would not be prohibited
by the regulation.
