A few years ago I was doing some work for a professional association on guidelines for dealing with litigants without
counsel and I was struck
by the extent to
which some
legal professionals regard litigants without
counsel as interlopers who gum up the finely tuned, well - oiled machine that is their justice system.
Originally, in England, a person charged with treason or felony was denied the aid of
counsel, except in respect of
legal questions
which the accused himself might suggest... Historically and in practice, in our own country, at least, [the right to a hearing] has always included the right to the aid of
counsel when desired and provided
by the party asserting the right.
Our lawyers also devote their time and expertise through the Equal Justice Initiative
which provides

which was not otherwise available from «control group» management; (3) whether the matters communicated were within the scope of the employee's corporate duties; (4) whether the employee knew that the communications were for the purpose of the company obtaining
legal advice; and (5) whether the communications were ordered to be kept confidential
by the employee's superiors, including that the communications were considered confidential at the time and kept confidential subsequent to the interview.8 When these elements are established, courts generally consider communications between company
counsel and an employee to be within the scope of the company's attorney — client privilege.9
