The main reason it can be said that litigation is more expensive than mediation is because solicitors are usually paid by the hour, and those whose arrangements are decided by a court take much longer.

Because the result is a mutually agreeable settlement achieved by the parties that is uniquely tailored to their family, the parties are much more likely to honor the agreement, thus reducing the chances of post-divorce litigation.

Divorce mediation is typically much faster than a traditional court proceeding: by avoiding potentially dozens of hours in the courtroom, couples can greatly reduce the cost of divorce as well as the stress of litigation, without sacrificing the enforceability of a legally binding agreement.

Collaborative divorce goes a step further than even mediation by putting so much emphasis on cooperation that the lawyers must resign if their clients choose litigation.
