Special Needs Bill March 3, 2015
by Grant Callen and Brett Kittredge Senate Bill 2695, The Equal Opportunity for Students with
Special Needs Act, creates a pilot program to give
parents the option
of withdrawing their
child from a public school and receiving an Education Scholarship Account (ESA) with $ 6,500 to help pay for educational expenses outside the traditional public school.
In this opinion, the New Mexico Attorney General declared that a voucher program under which the
parents of exceptional
children whose
needs were not being met
by the public schools could use the funds the school district would otherwise have spent on the
children to purchase
special education at private, nonsectarian institutions would be consistent with the New Mexico Constitution.
As documented under Section 1115
of Title I, Part A
of the Every Students Succeeds Act (ESSA), a local education agency receiving Title I funds «may use funds received under this part only for programs that provide services to eligible
children under subsection (b) identified as having the greatest
need for
special assistance... Eligible

Despite their sordid history, Blaine Amendments are today used not only
by Washington to deny educational opportunities for

special needs, but also
by opponents
of school choice programs to deny
parents the right to select the schools that are best for their kids.
This change has created a public relations challenge for the district
by raising concerns among
parents of general education students who feel that some
special needs students threaten the safety
of their

of teachers and administrators to be employed; (xiii) procedures for evaluation and professional development for teachers and administrators; (xiv) a statement
of equal educational opportunity which shall state that charter schools shall be open to all students, on a space available basis, and shall not discriminate on the basis
of race, color, national origin, creed, sex, gender identity, ethnicity, sexual orientation, mental or physical disability, age, ancestry, athletic performance,
special need, proficiency in the English language or academic achievement; (xv) a student recruitment and retention plan, including deliberate, specific strategies the school will use to ensure the provision
of equal educational opportunity as stated in clause (xiv) and to attract, enroll and retain a student population that, when compared to students in similar grades in schools from which the charter school is expected to enroll students, contains a comparable academic and demographic profile; and (xvi) plans for disseminating successes and innovations
of the charter school to other non-charter public schools.
