Although the judge's decision did not deal with whether or not the sexual abuse actually happened, this latest turn of events is something of a victory for SGM, whose legal strategy has been to first argue that the First Amendment gives
pastors the right to discourage victims of abuse from reporting the crimes
against them to police and second to argue that the
case should be thrown out on technicalities, such as the statute of limitations.
In the denomination to which I once belonged, the Evangelical Lutheran Church in America (ELCA), more traditional
pastors are beginning to wake up to the fact that, even if the civil government does exercise some restraint in compelling
pastors to act
against conscience, it is hardly the
case that their denomination itself will.
The
case against Stephen Boisson, another Christian, a
pastor, who wrote a letter to a local newspaper in Red Deer
against homosexuality was appealed to the Alberta Court of Queen's Bench who ruled in favour of former -
pastor Stephen Boissoin.
Freedom of expression is in my view a different
case: thus the Alberta Court of Queen's Bench got it right when it decided that a former
pastor could speak publicly
against homosexuality, short of inciting violence.
