Children who move due to a court - ordered
change in custody due to separation or divorce, or the serious illness or death of a custodial parent; and
Not exact matches
Such
change is an attempt to counteract overcrowded and lengthening pre-trial
custody in very bad jail conditions
due to very inadequate government funding of such facilities
Furthermore,
due to that
change in circumstances, it would now be
in the best interest of the child that
custody be modified.
Common reasons for modifications include
changes in child
custody, relocation of either parent, termination of a nesting arrangement
in favor of another parenting plan, or a
change in support
due to a significant
change in circumstances (such as
change in income, employment or health).
With all
due respect for the drafters of this bill, it is fundamentally so different from what it should be that I would rather we focus our energy on agreeing that we need to make
changes to the
custody system
in consideration of the best interests of the child and equal
custody so that both parents have access to the child.
In addition to objecting to relocating the child, the petition may ask the court to
change the
custody arrangement based on the move or have the moving parent pay for transportation costs incurred
due to a new
custody and visitation arrangement.
The possible sanctions include: compensatory time with the children; economic sanctions for costs incurred by the non-violator parent
due to the other parent's
custody or parenting time violation; modification of the existing transportation (pick up / drop off arrangements)-- including
changing the exchange location to a public place; ordering counseling for either or both of the parties and / or the children at the expense of the violator; ordering a temporary or permanent modification of the parenting time and custodial arrangement if under the circumstances this relief is
in the best interests of the children; ordering the violator to participate
in a community service program; incarceration of the violator with or without work - release; issuance of a warrant to be executed if the violator persists
in failing to comply with court orders; any other appropriate equitable remedy.
