I agree with Sarah and Kristin that the value
of citation tools and reference managers can be so much better exploited for primary legal materials drawn from
databases or open - web sources, including CanLII, so they are cited as what they are.
Those who rely «almost entirely (or entirely)» on Canlii for primary sources may depend on paper sources for historic content — a perusal
of legal research with pinpoint
citations to «page number (s)» would suggest such is the case because often content on the commercial
databases don't include the page numbers from the original print text from which they were reproduced.
In light
of the thousands
of documents included in the govinfo
database, researchers are likely best suited using either the Advanced Search page, which allows them to choose which resources they would like to search within, or the
Citation Search page.
At present, as you point out, you can get
citations for Canadian cases, provided that they've been cited in journal articles or U.S. decisions; and this could be a handy way to obtain the
citation if you're unable to query one
of the commercial
databases — and the case is too old to be on CanLII.
In addition to the point I made earlier, you will note that neither West nor Lexis (let alone CanLII) can look up each other's
citations with anything approaching a reliable level
of accuracy, whereas if you have a print
citation you can usually find a case in both
databases.
Specifically it directs the reader to refer to the Neutral
Citation, then to print reporters that are increasingly available only in
databases, and only last and seemingly least to the primary sources
of case law — the online services
of Lexis, Carswell, Azumet and Canlii.
If the case is only available on one
of the large commercial
databases, we should probably include that
citation as well as to the print reporter.
However, it would be in my view a huge mistake to include only a
citation to an electronic
database, since those
citations only work reliably if you have access to the
database in question, and do not work at all for automated indexing

Print
citations, on the other hand, are publically accessible, work well in all
of the
databases, and are
database - neutral such that they do not lock subsequent readers into using particular
database or another.
The practice direction from the Ontario Superior Court is similar to that

of many
of your concerns: only the neutral
citation is necessary for CanLII cases, lawyers should be encouraged to use CanLII versions
of cases, and it's unnecessary to add the date a decision was accessed to an electronic
database citation.
Parties citing decisions from electronic
databases should provide the
citations for any paper versions
of the decision in addition to the
citation of the electronic
database.
It can support the development
of federated
citation databases that help connect legal professionals to resources.
