For many practitioners the most important point that may come out of the consultation is the raising of the
limit of both the small
claims track and the fast
track.
The headlines were grabbed by increases in the small
claims track (other than PI) to # 10,000 and in the starting
limit for the High Court at # 100,000, the automatic reference to mediation of small
claims, changes to the enforcement process, and the creation of one county court jurisdiction.
What is concerning is that there is discussion at the highest levels, on an increase in the small
claims track cost
limit from # 1000 to # 5000 — and the consideration of increasing the number of cases caught by fixed costs.
