While I am a U.S. attorney, the U.K. and U.S. are essentially the same on these issue in practice: «reasonable wear and tear» is
a classic issue of fact to be decided by the judge (unlike the U.S. there are never juries in U.K. landlord - tenant disputes) based upon the evidence presented to him and his or her good judgment if the case goes to court.

The basic idea is that on an
issue of public concern, an honest opinion isn't defamatory unless it makes a reasonable listener think the speaker knows something that is in
fact not true (the
classic example is «In my opinion, Jones is a liar:» here the speaker implies he knows that Jones lied, which is a statement
of fact that can be true or false).
In Condron v. National Assembly for Wales and Another [2006] EWCA LGR 87 (where under consideration was the effect
of an observation to an objector
of the chairman
of a Welsh Assembly Planning Committee that he was «going to go with the Inspector's report») Lord Justice Richards had conducted a lengthy analysis
of all the relevant
facts and circumstances and felt «entitled, indeed required, to reach a decision on this
issue...» The court was there putting itself in the shoes
of the
classic «fair - minded and informed observer and making its own assessment
of the real possibility
of predetermination».
The only downside to be found here is the size
of the watches, which may not be compatible with smaller wrists — though that «
issue» is heavily mitigated by the
fact that the Gear S2 and S2
Classic are still on sale at new lower prices and will be receiving the latest software by the end
of the year.
It's far from perfect — in
fact, most if not all
of our
issues are identical to those in the NES
Classic — but even its flaws serve as a reminder
of an important, highly transitional era in gaming.
