At trial, the respondent claimed either a constructive or resulting trust interest in a property which the appellant alone held title, or an order
setting the relevant clauses of the
cohabitation agreement.
First, the party seeking to
set aside all or part of a
cohabitation agreement must demonstrate that one of the circumstances listed in s. 56 (4) has been engaged.
