As most readers who have been
following the «climategate» controversy will know by now, the U.K. House of Commons Science and Technology
Committee has released its report entitled, The
disclosure of climate data from the Climatic Research Unit at the University of East Anglia.
The
Committee (1) analyzes the general standards that lawyers must
follow under the Model Rules in protecting «confidential client information «1 from inadvertent
disclosure; (2) compares the risk of interception of unencrypted e-mail with the risk of interception of other forms of communication; and (3) reviews the various forms of e-mail transmission, the associated risks of unauthorized
disclosure, and the laws affecting unauthorized interception and
disclosure of electronic communications.
The appeals
committee will
follow essentially the same process as the discipline
committee with respect to
disclosure of evidence and notice of a decision.
