If British Columbia courts follow the Ontario Court of Appeal in Jones v. Tsige and determine that
the common law tort exists in British Columbia, there would be some important changes to the law and practice in this Province.
This OHS layer of legislation will duplicate and possibly conflict with other regulation and legal recourses including in the Criminal Code, the Human Rights Act, and Labour Relations Code, the Charter of Rights, the Workers» Compensation Act, and the
existing Part 27 of the OHS Code, not to mention most collective agreements and labour, employment and
torts common law.
