It is scandalous that any
profession should indulge in a restrictive
practice which, in the interests
of a privileged cadre, prevents some
of its
competent members from exercising their much - needed talents, and denies the nation the fruits
of costly apprenticeships for which it has had to pay good money.
In 2012, something happened that I called a sea change in the legal
profession: The American Bar Association formally approved a change to the Model Rules
of Professional Conduct to make clear that lawyers have a duty to be
competent not only in the law and its
practice, but also in technology.
Despite the current fashion
of devaluing the skills and knowledge needed for responsible and
competent law
practice, the
practice of law is in fact an art, a distinguished
profession, a sobering responsibility, and a privilege that should only be conferred upon those in society who are properly prepared in every way to shoulder the often times thankless weight and gravity that comes with it.
The Society strives to remain abreast
of changes in the legal services marketplace that may impact the
profession and consumers in Nova Scotia; be aware
of the expectations
of consumers
of legal services; demonstrate commitment to educating and assisting lawyers in achieving the goals
of competent and ethical
practice; and adopt clear and transparent means for enforcing adherence to these standards.
The Society maintains a regulatory framework that supports ongoing education
of the
profession and the articulation
of standards and best
practices to promote
competent, ethical, culturally
competent [18] and professional conduct.
The purpose
of the certification program is to conduct certification activities in a manner that upholds standards for
competent practice in a
profession, occupation, role, or skill.
Board certification at a high level
of practice is essential to every healthcare
profession — uniquely, it establishes the standards by which
competent practitioners may be identified.
It's also necessary to consider that the majority
of «
professions» also limit membership numbers to ensure that all
competent, qualified and
practicing members are able to work in that
profession should they have the desire and drive to do so.....
