covered entity, including a
covered health care provider, may disclose protected health information to OSHA under § 164.512 (a), if the disclosure is required by law, or if the disclosure is a discretionary one for
public health
activities, under § 164.512 (b).
We also include within the definition an organized system of health care in which more than one
covered entity participates, and in which the participating
covered entities hold themselves out to the
public as participating in a joint arrangement, and in which the joint
activities of the participating
covered entities include at least one of the following: utilization review, in which health care decisions by participating
covered entities are reviewed by other participating
covered entities or by a third party on their behalf; quality assessment and improvement
activities, in which treatment provided by participating
covered entities is assessed by other participating
covered entities or by a third party on their behalf; or payment
activities, if the financial risk for delivering health care is shared in whole or in part by participating
covered entities through the joint arrangement and if protected health information created or received by a
covered entity is reviewed by other participating
covered entities or by a third party on their behalf for the purpose of administering the sharing of financial risk.
As to the data collection
activities of a
public health agency, the final rule in § 164.512 (b) permits a
covered entity to disclose protected health information to
public health authorities under specified circumstances, and permits
public health agencies that are also
covered entities to use protected health information for these purposes.
Third, this paragraph allows
covered entities to disclose protected health information about an individual without the individual's agreement if the disclosure is expressly authorized by statute or regulation and either: (1) The
covered entity, in the exercise of its professional judgment, believes that the disclosure is necessary to prevent serious harm to the individual or to other potential victims; or (2) if the individual is unable to agree due to incapacity, a law enforcement or other
public official authorized to received the report represents that the protected health information for which disclosure is sought is not intended to be used against the individual, and that an immediate enforcement
activity that depends on the disclosure would be materially and adversely affected by waiting until the individual is able to agree to the disclosure.
Response: The final rule permits a
covered entity to disclose protected health information to a
public health authority authorized by law to conduct
public health
activities, including the collection of data relevant to death or disease, in accordance with § 164.512 (b).
