Employment & Human Rights Law in Canada Making Cyberbullying a Criminal Offence in Canada On Wednesday, the Canadian federal government introduced Bill C - 13, a «new»
cyberbullying bill to address the increasingly harmful effects of intimate images going viral online.
This «
Cyberbullying Bill» amended the School Code effective January 1, 2015, to make clear that student cyberbullying in «non-school-related locations» or via a student's own personal technology is prohibited if the cyberbullying causes a substantial disruption to the educational process or orderly operation of a school.
In
the cyberbullying bill, «bullying» would mean creating of a hostile environment by conduct, threats, intimation or abuse that reasonably has the effect of substantially interfering with a student's well - being, disrupts the school environment or causes a risk of physical or emotional harm.
The Journal News likes the fact that
the cyberbullying bill passed this session focuses on prevention and not criminalization.

Illinois Representative Mike Fortner, who sponsored the
Bill that amended the Right to Privacy in Schools Act, explained that the law «restricts the school's ability to access Facebook to only those specific cases of
cyberbullying which are either reported to the school or were observed by school personnel.»

bill defines
cyberbullying («bullying that is done through the use of any electronic communication device...») and adds it to existing bullying statutes.

bill provides the opportunity for injunctive relief for a victim of
cyberbullying, and raises the offense of «harassment» to a Class A misdemeanor if it was committed via electronic communication against a child with the intent to cause injury or suicide.

bill itself online might subject the legislature to being charged, since it is clearly intended to» «coerce» or «intimidate» young people into not being
cyberbullies.»
Remember that the Liberals backed down from their criticism and ultimately supported the Conservatives» lawful access, digital privacy, and
cyberbullying law,
Bill C - 13, for political reasons.
