From the legal viewpoint however, I don't think that
laws will be able to catch up with technology even if various countries are implementating
laws such as the Digital Economy Act or the
Cybercrime act.
Thus the Council of Europe (most European countries, plus Canada and the U.S. as observers) adopted the Convention on
Cybercrime in 2004 that requires member states to impose obligations on Internet intermediaries to keep traffic information for two years and make it available to
law enforcement and security interests.
I will look to Michael and David's posts to see what the
Cybercrime Convention might really require, as distinct from what
law enforcement folks put on their wish lists — things that they would not have even bothered to dream about pre-2001.
It's therefore increasingly imperative that lawyers and
law firms should be free to take all reasonable steps to ensure their clients are safe from
cybercrime and surveillance, using whatever encryption tools are at their disposal to achieve such ends.
If more cybercriminals move towards other forms of cryptocurrency, it will make tackling
cybercrime more difficult for
law enforcement.
