However, these cases involved situations either where the
applicants left their employment because of the sexual harassment they were experiencing (or were reprised
against) and such leaving was found to be tantamount to dismissal, as a result of which the
damages were increased.
This reality, when combined with the fact that the Tribunal lacks the power to award payment of legal costs, has meant that
applicants» victories may appear to be hollow when the time, effort, cost and risk of pursuing a human rights application is weighed
against the resulting award of
damages.
The
Applicant and her brother and daughter brought an action in
damages against the Respondents, alleging they had failed to assess, monitor and treat her condition properly, resulting in an aggravation of her injury and causing separate injuries that were not a logical and foreseeable consequence of the accident.
The Respondent made several submissions
against awarding
damages, but the court found attempts to shift responsibility for the error to the
Applicant «offensive.»
