This Regulation is not intended to apply to matters relating to social security, public measures of a general nature in matters of education or health or to
decisions on the right of
asylum and
on immigration.
However, in the domestic context its use has been focused
on asylum claims where it is applied by
decision - makers when assessing medical evidence.
A refusal by a senior immigration judge to order reconsideration of a case by a panel of the
Asylum and Immigration Tribunal can therefore only be reviewed under the statutory review procedure by a High Court judge, whose
decision on the review is final, and judicial review of the refusal to order reconsideration is not available.
The key points in the court's
decision were as follows: (i) It referred to the High Court's
decision in R (AW) v Croydon LBC [2005] EWHC 2950 (Admin), [2005] All ER (D) 251 (Dec) which held that where the fresh grounds for
asylum were «manifestly nothing of the sort» then a local authority considering whether an applicant's human rights required accommodation to be provided could in limited cases ignore the purported new claim and operate
on the assumption that there is no impediment to the individual leaving the UK.
Delivering the lead judgment, Lord Justice Beatson emphasised «the importance of giving separate consideration to the
decision on an application for
asylum, where the secretary of state decides whether it should succeed, and the
decision on certification, where she has to decide whether the application is «clearly unfounded» so that it is bound to fail and ought to be certified».
Where the
decision of an
asylum and immigration tribunal to dismiss an appeal against deportation was based
on a misdirection of law, its
decision can not stand, as it is not inevitable that it would have come to the same conclusion if properly directed.
