pretrial custody in Canada has expanded significantly.
Pretrial custody is when an accused
person is
detained in prison prior to trial.
Such accounts, however, neglect the criminal law's ability to
detain people for preventive reasons in the
pretrial stage of the criminal process.
The fact that unspecified future crimes that might have been committed by that
person may be prevented is merely an added bonus that goes into the cost - benefit calculation of whether it is a good idea to
detain someone, and into analyzing the terms of
pretrial detention that make sense.
