case law having been obiter — but that this particular claimant actually had.
The first is a decision of the Employment Appeal Tribunal (EAT) under Mr Justice Elias (President) giving guidance to tribunals on the thorny question of when a long - serving agency
worker transmutes into a
direct employee of the client; the gist of this guidance is to be much more cautious than previous
case law may have been thought to suggest.
Two
cases are particularly worth mentioning in this column, not only because of their
direct interest on, respectively, the relationship between an agency
worker and the agency, and the timing of statutory holidays, but also because they both raise an incidental issue that has been coming to the fore recently — namely when a tribunal or court is able to ignore written documentation on the ground that it is, at best, unrealistic or, at worst, a «sham».
One of the key developments in the last year has been the strong line taken against finding a
direct employment relationship between a long - serving agency
worker and the client or enduser, seemingly going against (at least the spirit of) Court of Appeal
cases in the previous few years, in particular Dacas v Brook Street Bureau [2004] ICR 1437, [2004] All ER (D) 125 (Mar) and Cable & Wireless plc v Muscat [2006] ICR 975, [2006] All ER (D) 127 (Mar).
