The right to PJI is
a discretionary remedy under sections 128 and 130 of the Courts of Justice Act (CJA), and s. 258.3 (8.1) of the Insurance Act refers back to those provisions in the CJA.
Where
no discretionary remedy is sought which can be provided by judicial review, the jurisdiction is not ousted.
Injunctions are
discretionary remedies.
